Terms of Service

1. Agreement

These Terms govern your use of agile-agilist.com and your purchase of training, coaching, and consulting services from Agile Agilist (“we”, “us”). “Agile Agilist” means the affiliated entity registered in the country serving your engagement, including Agile Agilist Inc. (Canada) and Agile Agilist LLC (United States). By using the site or enrolling in a course you accept these Terms. If you are enrolling on behalf of an organization, you confirm you are authorized to bind it.

2. Our services

We provide live instructor-led certification training (SAFe®, ICAgile®, and AI-Native tracks), digital learning content, career coaching, and enterprise transformation consulting. Course descriptions, schedules, and prices are as shown on the relevant course page at the time of enrollment. We may update curriculum to stay aligned with Scaled Agile, Inc. and ICAgile requirements.

3. Enrollment and payment

Seats are confirmed on receipt of full payment through Stripe or Eventbrite. Prices are in US dollars unless a different currency is shown at checkout, and are exclusive of any applicable taxes, which are added at checkout where required. Promotional prices apply only during their stated window. Certification exam fees for the first attempt are included where the course page says so; retakes follow the certifying body’s rules and our Refund Policy.

4. Attendance, rescheduling and cancellation

Certification bodies require full attendance to qualify for the exam. Cancellations, transfers, substitutions, and our Pass Guarantee are governed by the Refund Policy, which forms part of these Terms.

5. Intellectual property

Course materials are the property of Agile Agilist or the certifying bodies that license them (SAFe® courseware © Scaled Agile, Inc.; ICAgile® materials © their respective owners). You receive a personal, non-transferable licence to use materials for your own learning. You may not copy, resell, publish, or use them to deliver training. Recording of live sessions — audio, video, or screen capture — is not permitted without our prior written consent.

6. Session recording by us

We may record live virtual sessions for quality assurance and to provide catch-up access to enrolled participants of the same cohort. Recordings are not published publicly. You may keep your camera off or ask that your name be anonymized in a recorded session.

7. Third-party marks and certification outcomes

SAFe® and Scaled Agile Framework® are registered trademarks of Scaled Agile, Inc. ICAgile® is a mark of the International Consortium for Agile. Agile Agilist is a Scaled Agile Gold Partner and delivers courses under partner authorization; certification is granted by the certifying body upon passing its exam, not by us. Except for our Pass Guarantee, we do not guarantee exam outcomes, employment, or salary results.

8. Acceptable use

You agree not to misuse the site or services — including attempting to access other users’ data, scraping content for competing offerings, sharing exam content in violation of certifying-body rules, or disrupting live sessions. We may remove a disruptive participant from a session; the Refund Policy governs whether any refund applies.

9. Disclaimer and limitation of liability

The site and services are provided with reasonable skill and care, but otherwise “as is”. To the maximum extent permitted by law, our total aggregate liability arising out of any engagement is limited to the fees you paid for that engagement, and neither party is liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under applicable law, including under Ontario consumer protection legislation.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Courts located in Toronto, Ontario have exclusive jurisdiction, subject to any non-waivable consumer rights in your place of residence.

11. Changes to these Terms

We may update these Terms from time to time. The version in force when you enroll governs that enrollment. Material changes are posted on this page with a new effective date.
